By accessing and using Online Duka (the "Service"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.
2. Description of Service
Online Duka is an e-commerce platform that allows users to:
- Create online stores with customizable themes
- List and sell products or services
- Accept payments through M-Pesa and other payment methods
- Manage inventory and customer orders
- Use marketing tools to promote their stores
3. Account Registration
To use our Service, you must:
- Provide accurate and complete registration information
- Maintain the security of your password
- Be at least 18 years old or have parental consent
- Accept full responsibility for all activities under your account
Note: You may not create multiple accounts to abuse our free trial or promotions.
4. Subscription and Payment
Our Service operates on a subscription basis:
- Monthly Subscription: KES 400 per month after trial period
- Payment: Automatically charged via M-Pesa or credit card
- Cancellation: You may cancel anytime through your dashboard
All payments are processed in Kenyan Shillings (KES).
5. Prohibited Activities
You agree not to use the Service for:
- Illegal goods or services (drugs, weapons, counterfeit items)
- Adult content or services
- Hate speech, discrimination, or harassment
- Infringement of intellectual property rights
- Spamming, phishing, or fraudulent activities
- Reverse engineering or hacking attempts
6. Intellectual Property
You retain ownership of your store content. We own the platform code, design, and branding. By using our Service, you grant us a license to host and display your content.
7. Limitation of Liability
To the maximum extent permitted by Kenyan law, Online Duka shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of profits, data, or business opportunities
- Service interruptions or technical issues
- Third-party actions or content
8. Termination
We may terminate or suspend your account if you:
- Violate these Terms of Service
- Engage in illegal activities
- Fail to pay subscription fees
- Create risk or legal exposure for us
Upon termination, your store will be deactivated and data may be deleted after 30 days.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts of Kenya.
